By signing this Customer Setup Form, the undersigned (“Customer”) acknowledges and agrees to the following terms proposed by JYC Trucking LLC (“Carrier”).
1. Acceptance of Rates and Accessorial Charges
- Customer accepts all rates, fees, and accessorial charges listed in the quote provided by the carrier. This includes, but is not limited to:
- Pre-pull fees
- Storage charges
- Chassis fees
- Waiting time, dry run, demurrage, and any other accessorial explicitly stated in the quote or required due to operational circumstances
Customer agrees that these charges apply automatically when the operational conditions that trigger them occur unless otherwise agreed in writing.
2. Charges by Type
Pre-pull
Pre-pull fees will be charged for next day or future day deliveries. If a container is pre-pulled during the second shift between 5pm-2am for a next day delivery at 8am, a pre-pull charge will apply.
Storage Load
Storage load charges will be assessed anytime a loaded container needs to be stored in our yard. If a container is picked up and dropped off at our yard during the second shift of 5pm-2am for a next day delivery at 8am, a storage load charge will apply. Store load charges can be assessed in conjunction with a pre-pull charge. If a container is picked up and loaded on the same day, but there are no return appointments available for 6 hours or more after the container has arrived at the yard, then storage load charges will apply.
Storage Empty
Storage empty charges will be assessed anytime an empty container needs to be stored in our yard. If an empty container is stored in our yard during the second shift of 5pm-2am for a next day loading at 8am, an empty storage charge will apply. Empty storage charges can be assessed in conjunction with a pre-pull charge. If a container is picked up and delivered on the same day, but there are no return appointments available for 6 hours or more after the container has arrived at the yard, then storage empty charges will apply.
Port Waiting Time
Port Waiting Time charges will be assessed anytime there is port congestion. We will provide screenshots to validate the charges when the driver is in-gating and out-gating the port. The screenshots will be provided along with the corresponding invoice after completing the transaction. Port Waiting Time charges can start when the driver is in line outside or inside the terminal. Please note that terminals are often congested, and the lines to ingate a terminal can start a mile outside of the terminal.
Delivery Waiting Time
To ensure we always arrive on time, delivery waiting time charges will be assessed when our driver checks in with the warehouse even if the driver arrives 30 minutes before his appointment time. Proof of Deliveries fields should only be completed by driver and handed to the receiver for signature. Customers can request screenshots of the driver’s warehouse arrival and departure time as needed.
Port Chassis Split Fee
Split fees will be assessed anytime we have to make an additional stop to pick up the chassis and/or return the chassis at the end of the transaction. Unless the container is already on wheels at the out-gating terminal and the empty container and chassis can be terminated at the same terminal, a chassis split fee of $75 will apply for the additional stop. If we have to make an additional stop before picking up the container and another stop after returning the container, the chassis split fee is still the same at $75.
3. Credit Terms and Payment Obligations
Customer agrees to comply with the credit terms approved by JYC Trucking. Failure to pay invoices within the agreed terms may result in:
- Suspension of services
- Revocation of credit privileges
- Application of late fees
- Collection actions
Customer remains responsible for all charges incurred, including those resulting from delays caused by terminals, steamship lines, customs, or customer-related issues.
4. Invoice Disputes and Collections
All invoice disputes must be sent to billing@jyctrucking.com and accounting@jyctrucking.com within 10 business days of receiving the invoice. If the invoice is not disputed within the 10-day business day window, the original invoice amount will be expected to be paid. Please note that JYC Trucking LLC is backed by Allianz Insurance and all unresolved invoices and payments will be sent to Allianz for recovery. We strongly recommend for invoice disputes to be solved within 30 days of the invoice date so that the invoice is not defaulted and sent to collections.
5. Authorization to Obtain Credit Information
Customer authorizes its bank(s), vendors, and financial institutions to release credit information to JYC Trucking for the purpose of evaluating and maintaining credit terms.
6. Accuracy of Information and Legal Authority
The undersigned certifies that all information provided in this application is true and correct and that they have full legal authority to bind the company to these terms.
7. No Exceptions Without Written Approval
No modifications, exceptions, or special terms will apply unless expressly approved in writing by an authorized representative of JYC Trucking.
8. Binding Agreement
Submission of this form constitutes a binding agreement between Customer and JYC Trucking and confirms acceptance of all operational, financial, and credit-related policies.
9. Cancellation Policy
Customer agrees to the following cancellation fees, which apply per order and are due immediately upon cancellation:
- Same‑day cancellation: $225
- 24‑hour notice: $125
- 48+ hours in advance: $75
Customer acknowledges that cancellations disrupt scheduled operations, driver assignments, and equipment allocation; therefore, these fees apply automatically based on the timing of the cancellation.
